Agreement to Terms
By engaging services with Cyber Phoenix Technologies, LLC ("Company"), the individual or entity receiving services ("Client") agrees to be legally bound by these Terms of Service and Acceptable Use Policy. These terms apply to all services unless superseded by a written agreement.
Services Provided
- Managed IT Support
- Cybersecurity Services
- Website Design and Development
- Account Administration
- Custom Computer Builds and Hardware Support
All services are provided strictly within the agreed scope. Any work outside the agreed scope requires approval and may result in additional charges.
Payment Terms
- Payment is due as stated on invoices or agreements.
- Late payments may result in suspension of services.
- Accounts overdue by more than 7 days may be suspended.
- Accounts overdue by more than 30 days may be terminated or sent to collections.
- Payments are non-refundable unless stated in writing.
- Chargebacks may result in immediate termination and cost recovery.
Client Responsibilities
- Provide accurate and complete information
- Maintain backups unless included in services
- Follow security recommendations
- Provide timely approvals and access
- Use services lawfully and ethically
Acceptable Use Policy
Clients may not use Company services to engage in illegal activity, distribute malware, attempt unauthorized access, violate intellectual property rights, commit fraud, harass others, or abuse systems.
Violations may result in immediate termination without refund and may be reported to authorities.
Liability Limitation
To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, consequential, or punitive damages, including lost revenue, data loss, or business interruption.
Total liability is limited to the amount paid for the service giving rise to the claim.
Service Limitations
The Company does not guarantee uninterrupted service or prevention of all cyber threats. Services are performed using reasonable care and industry standards.
Scope Control
Any work outside the agreed scope must be approved in writing. Informal requests do not expand scope.
Termination
Services may be suspended or terminated for non-payment, unlawful activity, or violation of these terms. Outstanding balances remain due.
Governing Law
These terms are governed by the laws of the Commonwealth of Virginia.
